Our government's ability to incarcerate innocent people is evidenced by the number of those being exonerated, most often through DNA evidence. These wrongful convictions evidence our judicial system's failure. Trial Logs is currently covering the government's prosecution of those who question the application of the income tax laws. It is our hope that this coverage will help us understand the failings of our justice system and help those struggling to comprehend this nation's income tax laws.

The government has rested it's case and turned its attention to the intimidation of Irwins's witnesses who are now being read Miranda warnings before they take the stand to testify. Contrast that with the governments ability to grant immunity to their witnesses and the inequity of the system becomes quite clear.
Any defendant in this star chamber arena is severely disadvantaged. They are out spent, out manned and confronted with judicial bias.
This trial provides us a look at our government and justice system at its worst.

Larken Rose released this message today.
After much deliberation, Tessa has decided NOT to plea bargain. Her trial is currently scheduled to begin on Monday, October 17th (two weeks from yesterday). When we have more details, we'll let you know.
So, as it stands right now, this trial will take place in Philadelphia on October 17th. I'm sure she can use everyone's support.

Government's Case Sputtering
Schiff Facing Jail For Contempt
The criminal tax trial of Irwin Schiff entered its fourth week Monday with a cantankerous Schiff apparently making significant headway in repelling the government's prosecution witnesses who have testified thus far.
Schiff and his former co-workers, Cindy Neun and Larry Cohen, are defending against a plethora of criminal charges in Las Vegas stemming from consulting activities related to Schiff's best-selling book, "The Federal Mafia: How the Government Illegally Imposes and Unlawfully Collects Income Taxes".
The book, which contains a detailed analysis of the Internal Revenue Code and relevant Supreme Court decisions, was banned last year by a federal judge.
In the Federal Mafia, Schiff details how anyone can file a legitimate income tax return, claiming their income as "zero" because the Supreme Court has repeatedly, and consistently, defined the legal term "income" as meaning a "corporate profit or gain".
Schiff, who is arguably the leading expert and most troublesome public opponent of the 54,000 page Internal Revenue Code, has articulated in his speeches, written works and court filings that with regard to income taxes, the IRS has no legal jurisdiction over ordinary Americans and that there is no law actually imposing income taxes upon any individual. During the trial so far, no witness for the government has been able to cite the law actually imposing the liability for the tax.

Tax Honesty Proponent Irwin Schiff Exposes Corrupt Federal Judiciary

Now in the fourth week of his income tax trial, Irwin Schiff paints a sordid picture of the federal judiciary and the corrupt government that controls it by fear and intimidation. What this jury is seeing and hearing every day is shocking.
Irwin Schiff is not easily amazed. This 76-year-old fellow thought he had seen it all until the government dragged him into court yet again. But what he is witnessing in court now is the behavior of a government with no case trying desperately to fool a jury by resorting to outright lies.
After burning deep into its long list of witnesses for the prosecution, the government has yet to come close to making its case against Irwin Schiff. Instead, the government's witnesses have proved so favorable to the defense that one wonders repeatedly if the government hasn't made a mistake in its lists.
"And this was the government's witness?" the listener is heard to exclaim again and again.
This has happened so many times in this case that the government begged the judge to take some time out and flat out lie to the jury.
Throughout the case, a case in which the government has the burden to prove that Irwin Schiff had a legal obligation to pay income taxes and a legal duty to file income tax returns other than the ones he filed, Irwin Schiff has been forbidden by the government and by the judge from even mentioning the law. In fact, Mr. Schiff was sentenced to a day in jail for mentioning the law, then two more days, and then four more days. So far he has been punished with seven days in jail for mentioning the law he has been accused of violating.
Despite these obstacles, this old grandpa has persevered. He is hard of hearing, he has lost the use of one eye, and he has been gagged by the court, but the truth is strong and there is no way to suppress it. The government prosecutor recognizes this and understands he has not made a case against Irwin. So what is a desperate government prosecutor to do?
Lie to the jury. With the jury safely out of the room, the prosecutor asked the judge to lie to the jury with some highly unusual midtrial jury instructions, essentially telling the jury to disregard whatever favorable testimony may have come from the government's many witnesses and that no matter what the tax law actually says, the jury is to believe the opposite.
The judge, having sat through all of the proceedings and knowing that the truth contradicts what the prosecutor is asking for, called the jury back into the court room and . . . delivered the false jury instructions as requested.
