I had a face to face conversation with Bill Benson last week. He has not been indicted and is not standing trial. He has some administrative action against him, and he indicated that he needs to respond by December.

Lastly, Dr. Ward Dean's trial has been moved to December 5th.

77-Year Old Schiff Being Tortured
With Chain Shackles, Mistreatment


Imagine writing a book containing information so offensive and damaging to the government that the government prosecutes you for running a "fraudulent tax shelter" and the book is subsequently banned by a federal judge - without the government ever citing a single sentence that is false, misleading or fraudulent.

Imagine having your business raided and records seized using a court-sanctioned search warrant that fails to aver any specific law that you have violated.

Imagine the raid is conducted by a platoon of well-armed federal officers that have no delegated or statutory authority to conduct such a seizure.

Imagine then being indicted for allegedly committing more than a dozen federal tax crimes - each of which is predicated upon a crucial, but erroneous, legal presumption that direct, un-apportioned taxes on the labor of individuals have in fact, been legally imposed and that the government's prosecution is allowed to proceed without it ever having to establish for the legal record or prove before the jury that such a law exists - even though the Supreme Court has ruled it must.

Imagine filing more than a dozen legal motions over 18 months seeking to dismiss the charges for lack of jurisdiction, each one citing specific U.S. statutes and Supreme Court decisions leading to irrefutable legal conclusions requiring dismissal, only to have the government respond without substance that the motions are "frivolous" and then have the court delay its denial of the motions until just hours before the trial begins in order to prevent any appeal.

Imagine a "trial" where you are not allowed to question your accusers about the law or present evidence about the law, even though what the law actually says is the only question before the court and your entire defense is based on what the law actually says.

Imagine a "trial" where one morning, you witness the U.S. Attorneys emerging from a secret, ex-parte meeting in the judge's chambers about which you and your attorneys have no knowledge or notice and you have no idea what they discussed.

Bear with us as we switch to a new commenting system that will serve us better.

I would ask those of you that are critical of recent censorship to consider the following:

1. We all know the government is monitoring this site.

2. It certainly appears as though we have our share of agitators doing their best to stir folks up.

3. The agitators are succeeding at upsetting our good folks. As a result, some of the comments that have been left on this site border on threats.

4. I wouldn't be surprised to learn that the worst post on this site were placed there by government employees seeking to portray us as enemies of the state.

4. If the government can gleam our comment sections to portray this site as a collection of anti government terrorist, they will use that to attack anyone associated with us, thereby destroying our credibility and efforts to bring attention to the problems we see in this nations courts. Or worse, shutdown our efforts.

The purpose of this blog site is to bring attention to the problems we confront in this nations judicial system and to do our best to assure citizens are afforded due process in our courts. We want to bring attention to the injustices we see.

This site is not about taking up swords or any other acts of violence. You'll have to take those thoughts to another site.

This site is about finding peaceful solutions to the problems plaguing defendants in our courts. Right now, the priority is righting the wrong we just witnessed in the trials of Larken Rose and Irwin Schiff and company.

I know many of you are devastated by what we have just witnessed, which makes it even more important not to let agitators distract us from our mission.

Responsible comment on both sides of the issue are always welcome. If your sole purpose is to insult and agitate, please take it somewhere else.

I trust all of you understand why we must take steps to maintain the integrity of this site. Meanwhile, please send me an email at triallogs@ourliberty.net if you see a comment that needs to be purged from our mists.

Folks,

After listening to Mike Golden's update relaying his first visit with Irwin Schiff , it is obvious that things have taken a turn for the worst.

I would also encourage everyone to listen to Cindy's latest message.

In the midst of this sadness, the comments on this blog from the government's agents and supporters have become intolerable and inciting.

Emotions are running high and the government's detractors are infuriating many folks on these lists, causing them to say things they may later regret. I know we are all looking for peaceful solutions to the problems that confront this nation. Let's not lose sight of that.

For the time being, in order to restore order to this blog, I will endeavor to delete posts from the Frank Buckner's and other agitators whose sole purpose is the spread of their venom. My schedule only permits me to delete comments a couple times a day. In the mean time, please ignore such posts and resist the urge to respond, knowing I will delete them at the end of the day. Let's stay focused on the goal of reclaiming our judicial system.

The purpose of this list is to follow trials and assure defendants are afforded due process in this nation. We have just witnessed one of the worst examples of a trial the world has to offer with the defendants now fighting for their lives. My hope is without these distractions from the detractors, we might be free to formulate appropriate peaceful actions to free these people.
