Folks,

Last night's conference call (below) was very informative regarding closing arguments, and the case of Irwin Schiff, Larry Cohen, and Cindy Neun is now in the hands of the jury.

As we await a decision, I want to remind everyone of the upcoming trials.

Dr. Ward Dean (trial begins 10/24/2005)
Tessa Rose (trial begins 11/07/05)
Arthur Farnsworth (trial begins 11/28/2005)

We'll be doing our best to cover these trials.

The Roses's are facing over $30,000 in legal fees and can use financial support which can be sent to:

Larken Rose
P.O. Box 653
Huntingdon Valley, PA 19006

Arthur Farnsworth can you use your help as well. He has a web form at www.helpart.org

Much has been hidden from the jury in the Schiff trial. Despite that, there is hope that the jury will do the right thing. This would be a good time for prayer.

Did he physically harm you? If NOT, and I believe that is the case, what CRIME did he commit against you?

Don't you see, he didn't harm anyone. He offered his research and opinion based upon that research. Did you follow his opinion? I hope not for it is not wise to "follow" anything you haven't researched for yourself...even I am smart enough to get a "second opinion" with regard to important matters in life! If you followed and are unhappy that is your fault and you should throw "stones" at yourself.

If you did research beyond Mr. Schiff and tended to agree with your own research and you found yourself harmed, who in fact actually Brought Harm To You? The only answer is the IRS, not Schiff.

What we have here is, once again, a neo-Nazi type "thought" crime (alleged) and the victim is a piece of paper and ink. That is right, NO ONE was murdered, raped, tortured, wounded etc... by Mr. Schiff. Only a little piece of paper and ink with CONTRARY THOUGHTS were hurt
AND
YOU
have the audacity to stand up for a piece of paper and throw stones at a human being for thinking rather than throw stones at yourself for NOT?

You act as though Stupidity were a Virtue...answer me, Why IS THAT?

I am confident Irwin will win this case although there is a greater chance of a hung jury. I am sure there is a government plant among them. We all know that justice was never meant to be served. When Dawson applies his sanction Irwin will become a martyr. When we become active enough Dawson's disgraceful behavior will be in the spot light.
Many of us should go and seek asylum in foreign countries to gain international attention about this case. Asylum is only a temporary thing until this collective dictatorship is removed. It is time to get rid of this fascist fast becoming bunch of Nazi s and to bring back this once great Republic.

Schiff's nonsense caused allot of people harm and jail time. He must be held accountable.

By Anonymous Anonymous, at 10/18/2005 10:00 AM

Hello Jerry Hosteg here,

To Anonymous person who declares Irwin guilty:

Has the government met its burden of proving him guilty? Was an actual law(s) broken? Or was it the "law-making" judge's law that was broken?

You probably saw him guilty before you even met the guy. You definitely have a weak mind. In this country I believe people are innocent automatically until proven guilty, but it's people like you that want it otherwise.

Why should anyone have any respect for someone that thinks that way. We in this country despise that kind of system. And that kind of thinking.

U.S. Gvt's nonsense caused a lot of people harm and jail time. They must be held accountable.

By Anonymous Anonymous, at 10/18/2005 10:10 AM

First most people are blinded by fear . . . they even get angry at times because deep inside they know justice isn't being served to them or anyone else so they lash out at those who stand, because they know it makes them look weak.

Look at the Berlin Wall!! How many years did most Americans and many others around the world know it was an injustice.

But until kids grew up in families who struggled thru this injustice and became soldiers and officials and saw & knew of the grief . . . and people had seen so much grief that they finally came together. Then and only then did the wall fall. There had to be martyrs before it happened. People who suffered for the truth for everyone . . .AND YES EVEN FOR THOSE WHO THINK THEY ARE SO SMART AND JUST FOLLOW . . . ONLY OUT OF THEIR OWN FEAR, BECAUSE THEY AREN'T STRONG ENOUGH TO STAND FOR TRUTH AND JUSTICE.

Now with that being said, everything we sow we reap!!

The IRS can destroy anyone's life right now, even if there was an error made accidently using THEIR system. They have destroyed people for pennies. Many of those fearful people may be the next victim even following the IRS's system.

Well kids have grown, they have set their minds to changing another injustice. They have infiltrated the SYSTEM. They don't forget the horror stories they've seen and heard about that the IRS has done to innocent people.

I pray for those that are blinded and weak.

Irwin has offered to pay anything owed with a simple request . . . SHOW US THE LAW.

You can always tell when someone is lying because they will anger quickly, give answers that don't pertain to the truth and will try to make the honest ones look stupid. And they will do anything to hide the truth. EVEN IF THEY KNOW IT IS WRONG. But they under estimate the human heart for justice.

Some of the principles in life work in all areas of life. For example: Even the weak get strong thru resistance like lifting weights. You start out hardly able to lift any weight once or twice, but thru time and effort pretty soon we can lift more weight and many more times. This principle works with us and injustice. If we exercise the truth eventually we get stronger and can stand longer. AND MANY HAVE BECOME STRONG!!

The resolution: Stand on truth for justice! We all need to demand justice for all. We need to go to a flat tax where everyone pays the same percentage whether making $5,000 or $5 million dollars. Cut the fat out of the system(the IRS). Let the state governments tax for our roads, our needed systems and other needs. Let no one be strong-armed ever again.

Do the numbers . . . how much money would go back into our system if all this bogus system was eliminated? How many unjust legal procedures would be eliminated? How many are going to still act blinded as others get raped?

LET US ALL STAND FOR JUSTICE FOR ALL!! LET NO ONE ELSE BE PUNISHED, PERSECUTED, JAILED OR DESTROYED UNJUSTILY AGAIN!! Stand for what's right not just for youself . . . but justice equally served for everyone. THIS IS THE ONLY WAY WE WIIL WIN.

It is the corrupt system. The allies of evil being the IRS, the judges, the DOJ that has changed the lives of the people that followed Schiff!

God judges all! And when you here truth, and don't have a conscience to follow it, God judges that too! He sees you as not being able to stand (even unto death) for the truth because you were too afraid.

God didn't make us to be afraid of truth. The truth should be enlightening, an awakening. Of course the only way to oppose truth is through intimidation and fear. Something the government is soooooooo good at.

[Excerpts from the article suggested above]
"First and foremost, because when the federal government takes anyone to court, it’s a rigged game, because agents of the federal government are both prosecutor and judge." [how wonderful is that?]

"We have "separation of powers" on paper, but the reality is that no judge is going to declare the taxes that support his paycheck unconstitutional." [how wonderful is that?]

"The constitution is a mere document, and not very good to begin with, so despite any false impressions your government-school civics class may have given you, the constitution is powerless to save you from the feds." [that's right because the Consitution doesn't apply to the Feds only America, two distinct territories. The Consitutuion doesn't apply in Brazil either dah!]

"...there are, at least for now, other legal ways to lower your tax burden and strike a blow for liberty. [ya like Ltd. Partnerships, Corporations, LLC's, Statutory Family Trusts etc... all of which "lower" the revenue that the poster wants to not have happen...for he asks how to replace it...hmmm?]

AND NOW...drum roll please....

"One of them is making a tax-deductible contribution to an organization that advances the freedom philosophy, such as LewRockwell.com, or the Ludwig von Mises Institute." [Roll Over Rover - Play Dead - And instead of fighting win or lose, Don't give people like Schiff your money...Give ME and my people your money!

Whats wrong with this picture?

AND OF COURSE, he offers no solution but to give his organization money and they have also FAILED to affect a change for the BETTER! So what good is it?

One man's opinion just like Irwin but this guy wont fight and wont go to jail.

You see folks, some speak from both sides of their mouth, never reconciling first what the other side of their mouth said prior.

The article offers NOTHING about solution yet your poster does not slam him but will slam others, why is that? Because they agree. Roll over Rover and give me your money.

Finally, no mention of the acutal cause of this whole enchilada is mentioned...The Money System and how to correct it...It's ALL about Commerce don't you know!

By Anonymous Anonymous, at 10/18/2005 10:22 AM

You can lead a TP to wisdom, but you can't make him think....

You can't argue with this part:

"So let us summarize: No legal argument will magically exempt you from income taxes. Period. If it were possible, entrepreneurs would have jumped on top of it and made a killing on books explaining how to do it, and then the government would have closed the loophole."

By Anonymous Anonymous, at 10/18/2005 10:27 AM

Upon reading the comments with regard to an article, I just had to see where to find the article and read it.

No arguement here, all said is basically true, to a degree, but I would ask the same question that rabbit trail asked, where is the wisdom?

Not answered! Only insult offered!
As a Libertarian for over 25 yrs. it is sad to see the deterioration of thought and spirit. I guess I'll seek the Green Party, at least things will look pretty as it goes down the tubes!

The author, Huebert, somehow believes, without cite, that the "system" will somehow magically crumble, presumably by writting articles, talking and giveing "money" to the system, to Lawyers (oops he is one) and accountants, and to the organizations he suggests.

I am not very bright, but HOW is that going to colapse the system? His premise is that it will colapse, but how, since the judges and bankers are all on the same team running the show for their benefit, as he says?

Ahh, the same "magic" that he and others complain about the alleged T.P's. I guess.

Wasn't there people like Galileo, and Tycho Brahe that was burned at the stake for pursuing perceived truth.

Guess for those that don't or won't pursue the truth, the world remains flat.

Someone commented about that everyone would be circumventing personal income tax laws if indeed there was such a large misconception about application.

Further could be from the truth. I was witness to a very intense and in depth research project that involved reviews of the Congressional Record for years 1909 through 1913.

In that review we discovered comments being made by Congressmen about the selection of words involving proposed tax legislation such as person, individual, income, etc.

What was also recorded was the laughter by these same Congressmen at the prospect that the Court would miscontrue legislative intent from the abuse of general words and phrases involving tax law proposals.

Today and time has proven such absurd results.

There is no doubt in my mind the winds of change are upon us. Unfortunately it will be a revolution I believe because of the tyrants verses the over aggressive citizens. All hell will break loose once the American public finds out the corrupt nature of the beast.
The Gandhi way I urge all Americans who want their freedom back is the better way. As a man born British I know first hand the power this humble man sitting in heaven had on Britain. Get organized great citizens of America and conquer this government with the power of the green back dollar. FIND WAYS TO HIT THE GOVERNMENT IN THEIR POCKETS. My personal view is that the government is totally out of control and our president has become a king. I believe that the income tax is nothing more than armed robbery and makes us all into slaves. However, I also believe that the average American has become irreversibly complacent and blindly optimistic. The days of the Revolution and WWII in which people volunteered to fight and die for a cause are over. Far too many people trust the government and are willing to turn a blind eye to anything that might disrupt their precious daily routine of going to work, making money, spending all of that money, and then borrowing more. As such, the American people will not unify themselves to fight against the government - at least, not until it is far too late. They are like sheep being led to the slaughter.

I'm not saying that it isn't worth fighting for, as each individual has to stand for what is right even if no one else will. But, I'm also being realistic in recognizing that there are far too few people that are willing to fight, and consequently things are only going to get worse. Things will only change when they get so bad that the average American is forced to wake up and acknowledge that their rights are already gone.

If you think it's bad now, just wait. I firmly believe that things are going to happen in the coming months that will force that awakening. But again, by that time it will be too late.

Orwell was a socialist (thanks 1984 +21) and his fiction is now non-fiction.

I have asked Reasonable Guy, because he has proclaimed his self as reasonable and Moral if People should receive the same or similar tax benefits as a corporation, in that they can write off their living (cost of existence) expenses before paying the tax and thus paying only upon their GAIN/Profit? NO ANSWER.

I have stated the bible, which is presumably Moral, says to pay the church/god (tithe) as 10% of the Excess, or the Profit after living expenses. Should a tithe to the creator of your choice be paid prior to paying the government or should the government be paid first?

I find it difficult that those without a plan of action, without substance of matter and without suggestion for repair, will constantly ask others what to do for the expressed purpose to berate their explicit ideas, is somehow close to being a libertarian at heart.

Aguirre's pension suit dismissed
Conflict argument flawed, says judge

...

"Superior Court Judge S. Charles Wickersham
ruled that [City Attorney Michael] Aguirre's argument --
the defendants violated the state Political Reform Act
because they stood to benefit financially from decisions
they made on the pension -- was flawed.

"That law, Wickersham wrote, bars a public official
from making decisions in which he has a 'financial interest,'
a category that includes income. But income, according
to his ruling, does not include salary, pension payments
or other benefits received from a public agency.

"The judge said that 'pension benefits cannot as a matter
of law constitute the type of "income" resulting in a
"financial interest," which violates the Political Reform Act.' "

How about charging the government with fraud and calling 250 million John Doe and Jane Doe witnesses to testify that the government didn't disclose all the fraud and that judges get paid by the tax therefor will not rule on law etc...proving the fraud.

I mean 250 million people can't be wrong can they?

Some of you have commented on J. H. Huebert's Commentary on LewRockwell.com entitled "One Sure Thing in Life". I read the article and wrote back to him yesterday. I have had no response thus far. Here is what I wrote:

Hello Mr. Huebert,

Ref: http://www.lewrockwell.com/huebert/huebert11.html

It is a shame that I feel compelled to write this critical open letter to you. The reason is twofold. Firstly, I am a avid reader and promoter of both www.LewRockwell.com and www.mises.org. Secondly, while I revere the names of dedicated patriots like Samuel Adams, Patrick Henry, and Davy Crockett, on a scale from ideologue to pragmatist, I find myself, like you, tending toward the practical. Nevertheless, here goes.

"If you try to beat the feds at their own game, you will lose." In this, sadly, you are mostly correct. You point out one of the primary reasons about five paragraphs below. 'Separation of powers' is totally a buzz phrase that exists only on paper. Not only are the agents of the government both prosecutor and judge, most all of the agents of the government are attorneys - legislative, executive, and judicial. They view themselves as officials, not servants, and we, the people, capitulate. However, I take issue with your selection of the typical "tax protester" arguments. Your examples are easy to blow away. While having some basic merit, they are too esoteric to deserve honest consideration by a thoughtful people. There are more direct arguments that the uninformed and misinformed people can readily grasp.

The Irwin Schiff "tax" trial (triallogs.blogspot.com) currently in progress in Las Vegas spotlights two of those 'more direct arguments' that people can grasp. The first is that no one must pay a tax for which they have not been made liable. The second is that no one must be convicted of nonperformance if the prosecutor will not identify a legal duty to perform. The first seems logical enough. Suppose there was imposed an "editorial tax". Who must pay it? You? Me? Robert Novak?, The Washington Post? Every person in the 50 united States? No! Only the person made liable in the law must pay.

The second 'more direct argument' has its basis in the courts. In the supreme court decision in Cheek v. US, (111 S. Ct. 604)(1991), the court said that there were 3 elements to sustain a government case: 1) the government must identify a duty, 2) the person must know about the duty, and 3) he must violate that known duty. In the Schiff case, the government 1) did not show that there was a duty, and the judge 2) would not even permit this supreme court case to be entered into evidence - saying it was irrelevant! Is this obvious judicial tyranny?

Maybe, as you say, "the courts have heard it all before...." But who are they? Are they our officials or our servants. Will we continue to acquiesce, to capitulate, to surrender? When they say "jump", will we continue to say "how high, massa"? Will we escape to Turkey, as you suggest, and wait for the new world odor to catch up with us? Will we pass this inconvenience on to our progeny? Or will we resist the tyranny, now, and take back our country and our government? God bless Samuel Adams, Patrick Henry, and Davy Crockett.

PAY THE TAX AND DON'T COMPLAIN AND YOU WILL BE OK AND STAY OUT OF JAIL, YOU CAN STAY OUT OF JAIL, Learn how...READ ON.

An 81-year-old man, overseas action WW II and Korean War veteran, who filed his timely taxes for many years, was shocked one day when he received a notice from the IRS that he was delinquent. Upon receipt he promptly scoured his checkbook ledger to determine the exact nature and cause of the alleged problem. His ledger showed he had written a check for the correct amount, as determined by his tax preparer, and began correspondence with the IRS seeking resolution.

He paid quarterly but by the time they bothered to notify him the penalties and interest was more than the bill. You see sometimes the IRS doesn’t act timely. He contacted the taxpayer advocates office and they found “no problem” and couldn’t understand. Of course the records they used were over two years old and the problem didn’t appear.

After many attempts to resolve this issue, time ticked on with never a response to the actual problem, and the pressure mounted.

Because his bride of 40 years died with Alzheimer’s disease, he, after a couple years of IRS trouble, began to wonder if he was losing his mind. This thought troubled him.

The thumbscrew like pressure continued to mount even though the “service” never bothered to communicate about the actual problem, error or oversight. They only attempted to reconcile it by making him pay twice as much. The question becomes, did he write the check, as his ledger shows, and forget to put it in the envelope or did they receive it and lose it? Either way the idea that they lost it was never considered by the “service.”

With all seeming remedies exhausted, he finally turned to me for help. By this time the “service” was threatening to take his small condo and other possessions, though a “Notice of lien” was NOT filed. Scalpers began to contact him to “resolve” the matter for outrageous fees. It was later discovered that these “scalpers” might have actually been agents for or of the “service” upping the pressure.

I contacted and paid for a local attorney, who makes a living with IRS issues, to resolve the case somehow, whether by negotiated amount or other.

During the time the attorney had the case, this older man had hip surgery and a few other ailments. He had diabetes that he had to control and as it is with age he became frailer. However, though the IRS ceased with their phone and personal contacts, they continued with their letter attacks copying him those documents sent to the attorney. Now we all know that the wheels of justice grind slow and that justice is not always just, as in “JUST-US.

So the old man, having medical issues and worrying that he couldn’t do for himself, (fight his battle as any ex-marine would want) he then began to believe he may be getting senile like his departed bride, and began to show all the signs that intense “stress” can bring.

I knew this old guy and so I said good night to him one night. The next morning I didn’t hear from him, as was the norm. When I journeyed to his place I entered and looked about. Not finding him I began to wonder. I finally looked out on the enclosed patio to find his body lying over a box of newspapers and a bullet in his brain with those very brains oozing from his fractured skull. I also found the army style handgun he used. (see even in death he had honor and consideration to use the papers to catch the bullet so no harm could come to another). More honor than his government showed him.

The story I tell is true and for those who have yet to figure it out, the man was my father. CJ

US defends airstrikes in Iraq

US fighter jets and helicopters bombed two villages near the western town of Ramadi, killing up to 70 suspected insurgents.

But local police officers and doctors say the attacks killed civilians, including children.

Visualise Irwin, Cindy and Larry "not guilty of all counts"

By Anonymous Anonymous, at 10/18/2005 12:47 PM

I support Schiff’s views and have for the last 4 ½ years, but our government will be taking Schiff down, regardless of the outcome.

I heard of a man who knew the truth on the Waco fire incident years ago and now he has spent 8 years in confinement awaiting a trial, but the government refuses to give him a trial for anything they have charged him with. They know he can reveal the TRUTH in the trial so they just won’t have one.

Is it a waist of time to go to the expense of having a trial, especially if you are charged and convicted rather than just paying the tax?

Well, you will have to make that decision for yourself, but I guess Irwin would not be on trial if he just sold his materials as well as paying the extortion FEES.

By the way, isn’t Peymon in the same situation that was brought up against Schiff, Neun, and Cohen by asking for CASH ONLY which would be one way of hiding his ‘income.’

No verdict and it is 11:43AM Las Vegas time...could it be a split-jury?

By Anonymous Anonymous, at 10/18/2005 1:42 PM

Attention IRS!

The easiest thing to do today, if you want a tax protestor’s property, is just go to the city’s officials, in which the tax protestor has the property, and tell them the city can TAKE the property under the Eminent Domain Supreme Court ruling that was issued this year, and we will share the proceeds with you.

One story is here in which the city is taking a person’s land for which the city will be developing in the same manner that that person was going to do, but the profits from it will be totally given to the city, and no re-imbursement to the present land owner.

DOES JUDGE DAWSON HAVE THE POWER TO GO TO HELL?
During the entire Irwin Schiff trial Judge Dawson refused to inter into evidence anything that would help Mr. Schiff’s case that he was not forced to by law. If fact, he even forbade evidence which by law he was compelled to allow into evidence. As if that were not bad enough he also refused to allow all of Mr. Schiff’s witnesses whose credentials would have impressed the jury. Such as, a former FBI agent, one of the most renowned psychiatrists in the country, a much respected attorney from San Diego, a former IRS agent and others I fail to recall. This made me wonder just how far Judge Dawson would go to convict Mr. Schiff which led my fertile mind to conjure up this image.
When Mr. Schiff called this witness a murmur of shock echoed through the room as he entered the court. Judge Dawson immediately slammed down his gavel and roared, “Just by looking at him I can tell this witness would have nothing of value to say. The witness is excused and the marshals will escort him out of my courtroom!”
Suddenly three marshals appeared out of nowhere, rushed the witness and threw him to the floor which dislodged his crown of thorns. Then, as he struggled to get up it was obvious he was in pain from the large nail holes in his hands.
At that point a strange glow surrounded the witness which struck fear into the marshals, so they helped him carry his cross out of the room. But before the door slammed shut the witness turned, looked directly at Judge Dawson, and said, “You are pressing your luck with my old man!” To which Judge Kent J. Dawson answered, “How dare you or your father question my authority!”
On another subject isn’t it interesting the judge told Irwin he can’t participate in these blogs but allows the prosecution team and IRS agents i.e. Frankie Boy Buckner ect. to do so. The proof the prosecutors are commenting is the fact they site, by name and their attorneys name and the case numbers, of over twenty people who have lost in court. They also site obscure court rulings to prove their point. Who, other than disparate Federal Prosecutors, would have that information or bother to point it out? I believe if the person in charge of these blogs ran a trace on the commenters who site such cases then Mr. Schiff would be able to use that information should an appeal become necessary.
One of those prosecutor/IRS agents pointed out in a comment to this blog that anyone could get that information. The answer to that prosecutor is, “Yes. anyone can find that information. However, only a federal Prosecutor or IRS agent would do so because they have a dog in the fight.
And, as the jury takes the case it looks like their dog is a poodle while Irwin's is a vicious Rottweiler with its jaws tearing into the neck of your helpless Poodle.”
Now I know listening to the gurgling sounds coming from that white fur ball are sickening but the illegal crap must die for freedom to triumph.

Congress should pass a Victory Tax law like they did in 1942, but this time it would be for the victory over the debt, but I forgot they already have it as it never was rescinded by the IRS, even though Congress repealed it

THAT IS RIGHT! THE VICTORY TAX (THE WITHOLDING TAX) WAS REPEALED IN 1944 AS REQUIRED BY THE U.S. CONSTITUTION.

The only thing for them to do today to take your property and resell it is what I said earlier; just have the IRS go to the city’s officials, in which the tax protestor has the property, and tell them the city can TAKE the property under the Eminent Domain Supreme Court ruling that was issued this year, and the IRS will share the proceeds with the city.

LIVING BIBLE

T-shirt with holes in it, jeans, and no shoes. This was literally his wardrobe for his entire four years of college. He is brilliant. Kind of esoteric and very, very bright. He became a Christian
while attending college.

Across the street from the campus is a well-dressed, very conservative church. They want to develop a ministry to the students but are not sure how to go about it.

One day Bill decides to go there. He walks in with no shoes, jeans, his T-shirt, and wild hair. The service has already started and so Bill starts down the aisle looking for a seat. The church is completely packed and he can't find a seat.

By now, people are really looking a bit uncomfortable, but no one says anything. Bill gets closer and closer and closer to the pulpit, and when he realizes there are no seats, he
just squats down right on the carpet.By now the people are really uptight, and the tension in the air is thick.

About this time, the minister realizes that from way at the back of the church, a deacon is slowly making his way toward Bill. Now the deacon is in his eighties, has silver-gray hair, and a three-piece suit. A godly man, very elegant, very dignified, very courtly.

He walks with a cane and, as he starts walking toward this boy, everyone is saying to
themselves that you can't blame him for what he's going to do. How can you expect a man of his age and of his background to understand some college kid on the floor?

It takes a long time for the man to reach the boy. The church is utterly silent except for the clicking of the man's cane. All eyes are focused on him. You can't even hear anyone breathing.

The minister can't even preach the sermon until the deacon does what he has to do. And now they see this elderly man drop his cane on the floor. With great difficulty, he lowers himself and sits down next to Bill and worships with him so he won't be alone.

Everyone chokes up with emotion. When the minister gains control, he says, "What I'm about to preach, you will never remember. What you have just seen, you will never forget."

"Be careful how you live. You may be the only Bible some people will ever read".

I asked the Lord to bless you as I prayed for you today. To guide you and protect you as you go along your way......His love is always with you, His promises are true, and when we give Him all our cares, you know He will see us through. CJ

Virtually all the bloggers have concerned themselves with Irwin. However Cindy and Mr. Cohrn are also on trial. Did you ever question why. Well, there are legitimate reasons why Cindy might have been suspected of Social Security violations however that is not the reason she was charged on all the other charges. As to Mr. Cohen he was just an employee and the entire case against him was an IRS agent asking him to fill out a zero income 1040 for her. Mr. Cohen’s attorney’s cross examination of that IRS agent revealed she could not testify if Mr. Cohen filled out anything. Therefore the evidence against him is non-existent. So why were they charged and brought to trial? Well, I’m guna tell yous guys. In order to charge and try Erwin on “conspiracy charges” they had to show he conspired with someone! Without the conspiracy charges their case against Irwin was not that serious. However, that may be their Achilles heel because one would have to believe the jury will not believe a minimum wage employee with nothing to gain and a girlfriend who they cannot even prove made a salery would jeopardize themselves to conspire to defraud the government.

You guys never cease to keep me chuckling at your antics.

I've been saying all along that if you don't like the law, then work to change it through legal means.

Judge Dawson I'm sure is a fine Judge and only ensured that the court proceedings were conducted according to the law and enforced proper courtroom etiquet when necessary.

You guys seem to think there is something wrong with that just because you don't like the outcome.

Well Boo Hoo. You can always choose to leave the country.

"Websites like escapeartist.com can help you find the spot on earth that will be most pleasing and least burdensome to you. Books such as PT and PT2, by W.G. Hill, can also put you on the way to thinking about freedom far more pragmatically than the scheming tax protesters. There is a wealth of literature on this, and while it may not seem as heroic as fighting the government in court and going to jail for your beliefs, it works, unlike those other options, and is the closest realistic thing to individual secession from government available in the world today. "

Bon Voyage!

Here's another excellent article to read while you are waiting for the verdict....

http://www.reason.com/0405/fe.bd.its.shtml

"The tax honesty movement’s vision of the world is fantastical in another way. It is not merely obsessed with continuity; it is magical in a traditional sense. It’s devoted to the belief that the secret forces of the universe can be bound by verbal formulas if delivered with the proper ritual. There are numerous formulae in the tax honesty spellbook, with rival mages defending them. Which spell is best: The summoning of the Sovereign Citizen? The incantation of the Constitutional Definition of Income? The banishing spell of No Proper Delegation?

The tax honesty folks similarly believe that their foe the IRS must also be bound by these grimoires of magic: that without the properly sanctified OMB number an IRS form holds no power, that without uttering the mystic word liable no authority to tax can truly exist.

And always, always, the ultimate incantation, The Question: Where does it say that I owe income taxes? Show me the law!

"There Is Hereby Imposed on the Taxable Income of..."

You hear this all the time. When presented with the simple request to "show me the law that unambiguously requires me to pay income tax," I was told, everyone from congressmen to tax lawyers to IRS agents is stymied, even when Schiff and others offer enormous rewards to anyone who can do so. It didn’t take me long to find what seemed to be an answer to that question.

In U.S. Code Title 26, Subtitle A, Chapter 1, Subchapter A, Part I, Section 1, it says, "There is hereby imposed on the taxable income of...," followed by subcategories that seem to include most Americans, complete with tables showing the percentage owed for each income range. (Subchapter A even comes close to that magic word liable that many in the movement insist is nowhere applied to personal income taxes -- it’s called "Determination of Tax Liability.") But "taxable income" is the rub. Tax honesty types claim the "constitutional" definition of income, as set forth in such Supreme Court cases as Doyle v. Mitchell Brothers (1918), is corporate profits, not individuals’ wages. (Courts have knocked down this claim regularly during the last 30 years.)"

God hear our prayers. Thank you for this opportunity to become reaquainted with our founders, tax protesters that they were. May the breath of Samuel Adams be heard in the winds next whistle. Make his heart bristle.

For it was Sam who said, "If ye love wealth greater than liberty, the tranquility of servitude greater than the animating contest for freedom, go home. Leave us in peace. We seek not you counsel nor your arms. Crouch down and lick the hand that feeds you. May your chains set upon you lightly and may posterity forget that ye(Mr. IRS man) were our countrymen.

Of course, to enjoy his beverage today he'd roll in his grave seeing the sales tax attatched. He had the fortitude to initiate the Boston Tea Party, at least. But, God forbid we live in fear. April 15 will be near. NOT I...NOT I!

Let us show the founders what this generation can do for the torch of freedom. Or does it just look pretty lit on the lady in the harbor by NYC? Irwin's win or loss is irrelevant... dare I say frivolous(tee hee). The ire of a free man has been stirred.

Take notes all. One of us will win or we all will lose. United our spirits will be cast hence forth.

Although my thoughts and prayers are with Irwin and his co-patriots, and though I wish with all my heart that the jury would find them innocent, I also face the reality of no justice, no rule of law remaining in the United States today.

Considering how a not-guilty verdict would negatively affect the IRS's scheme to defraud Americans each year stealing untold billions from them, I seriously doubt the Feds will allow the jurors in this case to thwart their scam.

Considering also the innumerable crimes perpetrated against U.S. citizens by this unconscionable government already, the intimidation of a few jurors would pale in comparison.

God's speed to Irwin Schiff and friends - wake me up when Washington D.C. is in flames.

Looks promising for Mr. Schiff et al...no verdict on Day 1 of Jury deliberations....very interesting..

The Plaintiff and Judge made the instructions so convoluted that it will force the Jury to split.

By Anonymous Anonymous, at 10/18/2005 7:08 PM

"Courts have knocked down this claim regularly during the last 30 years"

..this week we learned first hand how "courts" do this: by instructing the jury the law is some fantasy cooked up by the "judge" while sanctioning the defendant at his own trial for citing the very law he is charged with...good one!

By Anonymous Anonymous, at 10/18/2005 7:11 PM

"...It didn’t take me long to find what seemed to be an answer to that question."

Ha!, I guess you are just one extremelly brilliant light!

By Anonymous Anonymous, at 10/18/2005 7:14 PM

The longer these jurors are out, the better. This signals (to me at least) that jury members are unable to reach an unanimous decision, one way or the other.

The outcome could result in a hung jury and a new trial for Schiff, with possibly the Feds offering Irwin and friends certain "concessions" later on in order for the government to slither out of the situation unscathed.

On the other hand, I've personally witnessed trials where juries were out for long periods of time, coming back with not guilty verdicts - let us hope this will be the same.

"taxable income" is only the subject of the sentence not the subject of the tax. The subject of the tax is a privilege as Per CRS and Congress!

The 1980 CRS report made the following statement concerning the nature of the income tax:
“Therefore, it can be clearly determined from the decisions of the United States Supreme Court that the income tax is an indirect tax, generally in the nature of an excise tax.”

In 1989, the revised and updated their report:
What does the court mean when it states that
the income tax is in the nature of an excise tax?
“An excise tax is a tax levied on the manufacture, sale, or consumption of a commodity or any various taxes on privileges often assessed in the form of a license or fee. In other words, it is a tax on doing something to property or on the privilege of holding some property or doing some act, not a tax on the property itself. The tax is not on the property directly, but rather it is a tax on the transaction.”
“When a court refers to an income tax as being in the nature of an excise, it is merely stating that the tax is not on the property itself.”

[Nowhere does CRS identify the so-called privilege that is the basis for the income tax.]

This “privilege” must be one of the most closely guarded secrets in American history. Neither the Internal Revenue Service nor members of Congress NOR THE COURT will identify the privilege.

In 1943, an analysis of the federal income tax was published in the Congressional Record. “The income tax is, therefore, not a tax on income as such. It is an excise tax with respect to certain activities and privileges, which is measured by the income they produce. The income is not the subject of the tax: it is the basis for determining the amount of the tax.” The fore stated excerpt of information was written by a former legislative draftsman in the Treasury Department and titled, “The Income Tax is an Excise Tax, and Income is Merely the Basis for determining its Amount.” CJ

I fully believe there is a gov't plant in the jury !! I'm certainly hoping and praying for acquittal but I believe "the plant" will cause a hung jury !! But maybe, just maybe, the remaining jurors can talk to him/her and make them come around !!! Joe Bannister & John Turner did years ago and left their cushy IRS posts !!! Sherry Peek Jackson did also !! They came after Joe Bannister, "one of their own" and lost miserably, AGAIN NOT CITING ANY LAW NOR PROVING THEIR CASE !! Exactly what's happened in Irwin's trial !! One more thing- I'm betting the jury HAS NOT FORGOTTEN the answers to the 3 questions they sent the judge (one being "What law REQUIRES you to file a tax return ?") HAVE NOT BEEN ANSWERED BY THIS WASTE OF LAW SCHOOL TUITION !!!! Sorry Dawson, you lie YOU LOSE !!!

By Anonymous Anonymous, at 10/18/2005 8:34 PM

Exactly, the 3rd question was never answered leaving the Jury in conflict with the Plaintiff's case. Thereto, the Jury probably smells something is awry here and will at minimum end in a 'hung jury'.

By Anonymous Anonymous, at 10/18/2005 8:41 PM

Mr. Buckner, if that is indeed your real name, I do not understand your obvious bias and contempt toward Mr. Schiff.

You consistently refer to Mr. Schiff as a being a con man and a criminal - even though you offer zero logical reason(s), or proof for your claims.

Are you not aware that the IRS and the Federal Reserve are criminal organizations operating outside the laws of this country?

Can you not see that Irwin Schiff and other Americans stand firmly opposed to and against the lies, deception and theft by corrupt, quasi-government offices?

Perhaps you prefer lawlessness, maybe you admire those who torture, kill, and impoverish others, however, even if you do, take note that you will eventually reap exactly what you sow.

To condone the IRS's scam and hide from its reality only prolongs your own misery as well as everyone else's - wake up to truth and realize that the FED is not your friend.

Mr. Buckner, I see that you've resorted to childish name calling and insults - seems you feel threatened. Actually your words reveal that you are responding out of fear. If you were secure in your beliefs, you would not be afraid and it would matter little what other people say.

Beyond your immature mannerism, your lack of communication skills and your apparent ignorance of economics, you further seek to blame other people for your own situation.

Income taxes have absolutely nothing to do with "your prices going up" and EVERYTHING to do with restricting the buying power of Americans.

The FED doesn't need to tax private-sector earnings to regulate prices. The Federal Reserve (a private, central bank) can at anytime print all the money it needs, decrease, or increase the money supply, and cause recessions, or depressions anytime the international bankers (who determine our economy) desire.

Income taxes are merely a control mechanism to keep the people willing servants forever enslaved.

I do not disdain you nor do I hate you - in fact I uphold your right to be wrong. At the same time though, I will not kiss your ass.

For your own sake, before you continue making a fool of yourself, do further research before passing judgement on those who seek to make life better for us all, even for you.

Damn you all for all the trouble you cause me, I can't sleep thinking of you. You caused all My personal woes and I hate you for it. It is your fault that the debt is only 2nd, percentage wise, to the time of WWII. It's your fault my money (because it's all about my money you see) is debt based and I can't pay for anything with it. It's your fault that the US has less economic freedom than Chile, Sinapore, Hong Kong and 10 other countries, You damn T.P's. you. I blame you for setting up the whole system and now you won't pay for it. You make me pay for it all by myself.

Now you be good little serfs and give the private foreign owned banking system about 500 million (collectively) or so and the debt owed to the foreign private corporation will be???....well only nearly $8 Trillion.

Now that's good economic sense err I mean cents! CJ

If Judge Dawson IS THE LAW, then way is the jury out deliberating the final years of Irwin’s life?

Yes the actual LAW, the code, says: "There Is Hereby Imposed on the Taxable Income of..." and for me that means ONLY the TAXABLE ‘income’ NOT the NON-TAXABLE ‘income.’

Why are not ALL Americans required to file a tax return, as many of you believe it is required when a tax IS IMPOSED? Therefore, if that is true then you are mandated by LAW to file a tax return for EVERY tax in the book regardless of whether you had earnings of that type of tax!

I was listening to Schiff’s tapes again while I was driving, which I have listened to about 135 hours of them several times over, and in them I heard that he was allowed to file a ZERO return back 20 years ago to be let on parole. His parole officer and the IRS allowed it and now they are NOT. I guess the government can backtrack and change their mind, so I guess Irwin will go back to prison for NOT filing legitimate returns 20 years ago.

Why from 1914 through 1942, 29 years, were there only 11% of the people paying the ‘income’ tax? Did the IRS mess up by NOT collecting a tax that was mandatory? After the Victory Tax of 1942 was passed the government needed publicity!
“The new legislation gave Henry Morgenthau, then Secretary of the Treasury, two voluntary income taxes to which he needed the voluntary compliance of US citizens. In December 1942, Morgenthau came up with a brilliant idea to encourage Americans to volunteer to pay by making the income tax a patriotic duty. To help implement this idea, Morgenthau ordered John J. Sullivan, a Treasury Department official, to contact Walt Disney. It was a movie leader, much like a newsreel or preview, added to nearly every movie in the midst of World War II. The story started with Donald Duck, a patriotic little fellow reluctant to pay income taxes. Listening to a radio broadcast about taxes, Donald gradually realized that paying the income tax would help win the war. With a whole new attitude, Donald quickly goes to work filling out his income tax return, and so enthusiastic about paying the tax that he races from California to Washington to submit his tax return in person.”

It looks like a RIOT in Las Vegas like in 1992 with Rodney King, but this time it will be under control by the Bush administration’s Martial Law as they did in New Orleans where many of those people are now slaves.

THE GOVERNMENT CAN PRINT MONEY TO PAY THE DEBT, BUT THEY WANT CONTROL OF YOU!!!

I've been saying all along that if you don't like the law, then work to change it through legal means.

Post 10/18 5:45

We don't have any problems with the laws other than the fact that the IRS refuses to obey them.

When you say change the laws by legal means, your not suggesting voteing into office like minded reps. That's a waste of time, it's a rigged game. I can't fit a credit card between the two parties. I firmly beleive that if Mother Teresa where elected to congress she would be corrupted in 8 micro seconds.

That path to recovery is null.

Frederick Douglas said in 1849, "Power concedes nothing without a demand. It never did, and it never will. Find out just what the people will submit to and you have found out the exact amount of injustice and wrong which will be imposed upon them; and these will continue until they have resisted with either words, or blows, or by both. The limits of tyrants are prescribed by the endurance of those whom they suppress."
