Irwin Schiff Trial update by Mark Yannone

Does not this remind you of the ramblings of a favorite uncle who's hit too much of the bottle during a family get-together? He's insane folks, stop placating him and allow him to get the help he needs so badly.

I think what Irwin said made very good sense and is indeed very scary!

This is what happens when the people do not investigate for themselves. Irwin has only followed the law itself, and not what the IRSS tells him is the law. They say that the person is crazy, or worse. Just go to the g-ment website for title 26, the IR Code and see for yourself. He IS NOT LYING!!

The fact is that throughout the history of civilization, those that question the right of the sovereign to enforce direct taxation are regarded as heretics. The rulers make the laws to whatever benefits them for they have the keys to the jail cell....

"Because the judge will instruct the jury on the statute at the end of the trial. Statutes have never been introduceable into "evidence" in the 700+ year history of Anglo-American jurisprudence, Irwin's continuing desire for special treatment notwithstanding.

That none of you TPs understand this, or have more than a Wal-Mart level of understanding of the evidentiary rules is quite predictable. But of course you see it as part of the "giant conspiracy" though it would be the same result in a murder case or a grand theft auto case too.

You may return to your window washings and pool cleanings now."

First of all, the CONSTITUTION is not even close to 700 years old and it is the CONSTITUTION, which is the law of THIS land. Second, those who are representing themselves pro se are supposed to have more lattitude in court anyway. So he SHOULD get special treatment.
Third, Anonymous said that he doesn't need the job at Wal Mart anymore. Your wife supports him.

The language of the law is central to all tax cases, but to the greatest extent possible, the jury is kept ignorant of the law, and justice is denied.

Once a society recognizes that justice is impossible in a court of law, violence will escalate radically, and no one will be immune from it.

We are rapidly approaching the point of blood running in the streets. I think within 5 years. Shorter if the bastards don't back off.

The Greatest Threat

There is no greater threat to Liberty in America, and consequently to Her strength and durability, than the loss of the ability of the People to hold their servant government accountable to the Principles of the Declaration of Independence, the Constitution and the Bill of Rights.

With accountability, the cry for Freedom of each individual is maximized and the Rights of the governed are secured.

Liberty is directly proportional to accountability. The more the People are able to hold government accountable to these essential principles, the greater their Liberty.

The First Amendment provides a guarantee of the primary methods for exercising accountability. Of crucial importance is the Petition clause, which unlike the other clauses (which enable personal expression, belief and association) brings the People and their government into a direct confrontation, and results in a public declaration of individual Liberty or governmental Tyranny.

Petitioning the government for Redress of Grievances is nothing less than a peaceful rebellion of citizens seeking to keep their government in its proper place: as a servant of the People, created through a written Constitution for their service and protection.

The Petition is the period at the end of the sentence on Liberty. It is the capstone Right, the ultimate peaceful deterrent to the abuse of power in government, a protection against the theft of Freedom from the People.

revolution is nigh when the common man bristles at the merest touch of government. it may be soon that righteous contempt will reach that level.

"Once a society recognizes that justice is impossible in a court of law, violence will escalate radically, and no one will be immune from it."

No truer words could be said. Sadly, this is where the U.S. will have to go before things turn around.

How can ANY case go forward until the jurisdiction of the court is ESTABLISHED and the JUDGE TO QUOTE WHAT LAW OR STATUTE GIVES HIM THAT JURISDICTION ? This judge just spoke up "okay, I'M SAYING I HAVE JURISDICTION !! Didn't quote ANYTHING giving him that jurisdiction !!! BECAUSE THERE ISN'T ANY !! And timed it just so Irwin COULD NOT RESPOND due to time constraints on the case beginning !!! What would o' been the big deal of cameras in the courtroom after we watched O.J. and Michael Jackson plastered ALL OVER OUR TV FOR MONTHS ? That WOULD guarantee Irwin a fair trial, wouldn't you think ? Wake up folks !! Irwin is FAR FROM CRAZY !! Hell, I'm only 44 and I wouldn't want the "mental load" this case would place on me !! And "pro se" is your best bet because unless you can afford the Bernhoft law firm, you won't find a "middle of the road" priced lawyer IN THIS COUNTRY that would take it !!! WAKE UP FOLKS !! There are questions the size of an 18 wheeler that needed to be answered and the "credible statutes and laws" backing the government's NON GIVEN answer BEFORE THIS CASE EVER WENT TO TRIAL !! Can ANYONE out there spell JUDICIAL MISCONDUCT ?? !! UNBELIEVABLE !!!

This is no surprise. The U.S. Judicial system has achieved what Thomas Jefferson warned many years ago:

"To consider the judges as the ultimate arbiters of all constitutional questions [is] a very dangerous doctrine indeed, and one which would place us under the despotism of an oligarchy. Our judges are as honest as other men and not more so. They have with others the same passions for party, for power, and the privilege of their corps... and their power the more dangerous as they are in office for life and not responsible, as the other functionaries are, to the elective control. The Constitution has erected no such single tribunal, knowing that to whatever hands confided, with the corruptions of time and party, its members would become despots. It has more wisely made all departments co-equal and co-sovereign within themselves."

Letter to William C. Jarvis, 1820

Just last month the WTP-RTP was denied by the Judge in a Federal District Court. The Judge claimed that the Gvt. does not have to repond to petitions by the American people. Thereto, the Judge has abolished the 1st amendment of the U.S. Constitution by claiming that the right to petition by the American people no longer exists.

You should never ask for justice in a court of law. Emporer Justinian was a tyrant. What you should ask for it fairness and objective analysis without bias. Of course all the judges are obediently filing their tax returns. -Jay www.spikessystems.com

Hey Dr. Freud!

So the help you'd advocate for the insane who need help is criminal prosecution and subsequent incarceration. Wow --- at least you picked a germanic moniker for your post but wouldn't "Dr. Leonardo Conti" have been better --official Doctor of the 3rd Reich whose primary responsibility was the euthanizing those of 'unsound mind'. Of course if that were the law of the land, your kind would be the first to go.

**yawn**! Hasn't this loon been convicted yet?

Wasn't Galileo imprisoned because he took up the argument from Copernicus that the earth revolved around the sun, not the other way around? He had supporters, but not many brave enough to take on the church/government. He also had detracters that insisted the church/government were right and would never try to deceive the masses. I think Galileo has been re-incarnated in Irwin Schiff.

"Laws are made for men of ordinary understanding and should, therefore, be construed by the ordinary rules of common sense. Their meaning is not to be sought for in metaphysical subtleties which may make anything mean everything or nothing at pleasure." --Thomas Jefferson

"But with respect to future debt; would it not be wise and just for that nation to declare in the constitution they are forming that neither the legislature, nor the nation itself can validly contract more debt, than they may pay within their own age, or within the term of 19 years." --Thomas Jefferson

"There are more instances of the abridgment of the freedom of the people by gradual and silent encroachments of those in power than by violent and sudden usurpations."
- James Madison

No, Schiff is just crazy, and is about to be a THRICE-convicted felon.

Still funny to me how little support Irwin is now getting. Reminds me of Lynne Meredith, who had thousands of clients but nobody bothered to show up at her trial.
