The following letter to the editor was printed today in the MontCo/Bucks
Co. Intelligencer (and I assume in the sister papers as well).

I note with some annoyance that they deleted the sentence with the URL
and the paragraph about the kangaroo. Otherwise it made it out intact.

To the Editor:

Imagine that you're driving your car and come to a green light.
Inexplicably, other cars are stopped for it. You safely proceed through
the intersection but are immediately pulled over by the police and given a
ticket for running the green light. When you look at the ticket, it
doesn't say what law you broke or what the fine is, and when you appear in
court to ask what's up, you receive no answers and are thrown in jail.

An outlandish scenario? Absolutely! But it describes what happened to
tax honesty advocate Art Farnsworth.

From his research, Art concluded that there is no law requiring the
average American to pay the federal income tax. When he asked the IRS to
show him the law requiring it, they wouldn't comply (i.e., couldn't
comply), so Art stopped filing. The IRS then brought charges against him,
but they never identified which law Art broke by not filing, which tax he
owed, nor how much. Despite the lack of any assessment, they convicted
Art anyway for not paying a tax he didn't owe.

Where is the outrage, the outcry? Have we become so numb to the chronic
erosion of our rights that we just knuckle under when faced with the
kangaroo court of IRS trials?

Alarmingly, these sorts of unbelievable horrors are not only happening to
poor Art Farnsworth. First they came for the tax honesty advocates, and
now America routinely throws people in prison, tortures them, and
confiscates all their assets without a trial, again to no outcry. Even in
those rare cases where the citizenry does awaken, such as when America
invaded another country on trumped-up charges, the outcry falls on deaf
ears. Clearly, America is in a dangerous downward spiral and heading for
a nasty crash landing with all of us aboard.

Fortunately, Aaron Russo (producer of the Eddie Murphy movie Trading
Places) has released a new documentary, "America: Freedom to Fascism",
detailing the truth behind the income tax fraud and many other ills of our

You owe it to yourself and to America to become educated about the fraud
the IRS is foisting upon us -- and soon too, before America's Darth Vader
chooses to target you as well.

A New Hampshire man has gained national media attention by his refusal to surrender to federal authorities after being found guilty by a federal jury of tax evasion. The media is mystified by the national movement of supporters converging on Mr. Brown’s New Hampshire home, many of whom are willing to risk their own lives to stand with him, even sleeping outdoors in a New England winter. This documentary explains the complex issues surrounding these events, and contains exclusive video footage of Mr. Brown explaining his position, and his determination to be killed defending himself against any government efforts to take him into custody.

Aaron Russo’s film “America: From Freedom to Fascism” (www.freedomtofascism.com) has been attracting interest across the nation, and Mr. Brown is one of many who believe the federal government lacks the legal authority to impose federal income taxes on Americans. The government seeks to discredit Mr. Brown through his conviction and presumed incarceration: "Some people are drawn to the anti-tax movements and the false representation that there is no legal requirement to file and pay taxes. Today's verdict clearly reaffirms the repeated rejection of these arguments in the courts," IRS Special Agent Douglas Bricker said in a statement after Thursday's court ruling. The mainstream media are not reporting on these other issues, and are perplexed by what they see as a lone criminal preparing to die violently, backed by growing numbers of people from disparate backgrounds.

A Vermont lawyer and writer who has criticized the Bush administration in a well-researched book entitled “Christian Words, Un-Christian Actions: George W. Bush and the Desecration of Christianity in Modern America” (www.christianwords.us) grabbed a camera and traveled to New Hampshire to capture the full story of Mr. Brown and his supporters. The video is shot by his wife, and the couple is clearly not fearful of the Brown clan: further, they have been trusted by Mr. Brown to tell the story where other media are distrusted and excluded. This video powerfully explains what this is really all about, and why this standoff is likely the beginning of something much larger.

The Art Farnsworth verdict

If you have not yet heard via the media, the jury came back after just one hour of deliberation with a guilty verdict on all three counts, late Friday afternoon. The defense rested earlier that day, and due to the number of jury instructions, the jury did not go out to deliberate until around 3:30 p.m. That would have been enough to worry me, save for the fact that I believed we had prevailed to that point in what was generally considered to be a fair trial. The jury returned at 4:30, per the judge's instructions, not with a request to come back on Monday, but with verdict sheets in hand. It was then that I started to worry.

I have issues to discuss with attorneys about things upcoming, and I am not going to say anything at all at this point in time about those things. The sentencing is scheduled for early March, so I have until then to work on some things.

I thank all of you who provided support, be it conversational, prayerful, or financial. Don't stop now, as I'm not done yet.

I have decided to reduce my profile, and hopefully by doing so no longer be a target. America needs brave individuals to stand up and save her, and I have done that for the better part of a decade now. I will continue to be a patriot, but perhaps as a part of a group, rather than as a lone soldier.

Well everyone,

After deliberating for less than two hours, the jury found Art guilty on all counts. There were highs and lows throughout the day, but I'm not prepared to convey all of my thoughts at the moment.

In the final analysis, I must say that Art had a fair trial, with a fair judge. Many of us found the jury instructions to be quite fair with some stating they were better than any they had heard in other cases.

The prosecution portrayed Art in the worst possible light, and the defense obviously failed to convince the jury otherwise.

Art is a good and decent man and it must be obvious to the prosecutors and the court. To their credit, the prosecution made no request after the verdict regarding Art's dispostion. They didn't ask for him to be taken into custody, and they didn't ask for increased bail. There was also a recommendation by I believe it was court services to continue Art's present bail condition. The judge concurred with the wishes of all, so Art was free to leave. Sentencing will be in March.

These tax cases are tough. The government has the advantage. The mindset of jurors is that everyone is surely required to file and pay and anyone who questions that must be dillusional. The issues raised by the defense appear to be far too complex for the average juror to grasps, and much of it goes right over their heads.

I need some time to collect my thoughts.

The government rested its case today in my tax evasion trial. My attorney Mark Lane has done a very impressive job of cross examining the government witnesses, in essence tearing two key ones to shreds. It kind of hurt to see this, as they were friends of mine from the past, and I still care about them. My church pastor testified at the end of this afternoon as a character witness, and I have two friends testifying on my behalf tomorrow morning. We start at 9:30, and I expect to take the stand in my own defense perhaps around 11:00. I believe we are planning to submit a motion for a directed verdict of acquittal, which is a request to the court that it dismiss the case when it is clear that the government has not, at the end of its presentation, met its burden of proof. Keep your fingers crossed!

The defense should rest tomorrow, if we lose the motion attempt, which means the jury is instructed and goes out for deliberation at the end of the day.

The judge has been fair, the lawyers have been great, my spirits are up, and we are all maintaining good thoughts for a victory. Please keep me in your thoughts and prayers. If you would like to attend, the courthouse is on the 600 block of Market Street in Philadelphia, and we are in courtroom 17B.

The trial is going well, with jury selection and opening statements on Monday, government witness and good cross examination today (Tuesday). The government will be presenting its two final witnesses on Wednesday, and it's possible that the testimony of my witnesses and even my testimony might begin in the afternoon. I am very pleased with the job my attorneys are doing, and Judge Padova continues to remain the fair and impartial judge that everyone would like to have.

Keep me in your thoughts and prayers. Nobody knows how this will work out, and it would be wrong for me to predict anything, even in the light of events thus far. I am upbeat, having fun (at attorney Mark Lane's request!), learning much, and hopefully growing stronger as a result of my travails.

Here is an update on Irwin Schiff posted by "the Constitutionalist", one of our commenters.

When Mr. Schiff was not allowed to present evidence or witnesses at his trial the IRS agents and pro prosecution types that haunt this blog spot denied those facts. When the IRS illegally took Mr. Schiff's commissary funds which kept him from buying anything in prison to make his life tolerable they were silent. Well, here is another activity the employers of all DOJ and IRS agents are engaged in they can be proud of.

Mr. Schiff requested his sentence be served in Connecticut. The real criminal during Me. Schiff's trial, Judge Dawson, granted that request. However, that is not exactly what happened. During a four month period the almost eighty year old Mr. Schiff was transferred from Las Vegas via New Mexico to Arizona. Then to California. Next came Oklahoma. Now he is in New Jersey. Each time he was shackled hand to foot and in a cage on a bus sitting on a hard bench for hours on end. This is referred to as "Diesel Therapy."

Even though they know Mr. Schiff has a condition that prevents him from feeling anything below his knees they made him wear army boots. After he removed those boots his socks were soaked with blood and all the skin had worn off of his toes!

Not only is he being his physically tortured but because the prison system does not forward mail it also keeps Mr. Schiff from receiving mail from the people who are helping him with his appeal or are concerned about his welfare. Five of our letters to him have been returned as "Unknown Inmate."

We will not be surprised if the next address for Mr. Schiff is Guantanamo Bay Cuba, Abograve or Boot Hill in a unmarked pauper's grave.

It is obvious to us this is a effort to incapacitate or kill Mr. Schiff to shut him up before he can embarrass the federal justice system during his appeal.
Therefore, we hope those DOJ employees and IRS agents beam with pride as they tell their grandchildren just how proud they should be of the humane way their masters treat a proud, honest patriot whose health is failing.

Vermont judge rejects U.S. Supreme Court search ruling

GUILDHALL, Vt. --A Vermont District Court judge has rejected a recent U.S. Supreme Court ruling on the power of police to search a private home, concluding that the state offers greater protections in such cases.

Judge Robert Bent said that under the state Constitution police must knock and announce themselves before conducting a search, even if they have a warrant, or face the prospect that any evidence they find could be thrown out.

The Supreme Court said June 15 that evidence obtained without first knocking could be used at trial, but Bent said that would not apply in Vermont.

"Evidence obtained in violation of the Vermont Constitution, or as the result of a violation, cannot be admitted at trial as a matter of state law," Bent wrote, citing an earlier state case as precedent. "Introduction of such evidence at trial eviscerates our most sacred rights, impinges on individual privacy, perverts our judicial process, distorts any notion of fairness and encourages official misconduct."

A defense lawyer in the Vermont case said Bent's ruling was an important statement. "Sanity prevails in Vermont," said attorney David Williams.

Bent agreed with the dissenting opinion in the federal case, which said allowing otherwise illegally obtained evidence to be used could lead law enforcement officers to ignore the law.

"The exclusionary remedy should remain in full force and effect," Bent wrote, "at least in our small corner of the nation."

Unless the attorney general's office appeals Bent's ruling to the Vermont Supreme Court, it applies only to the drug case he was hearing and would not be binding on other judges, legal experts said. But other judges are likely to take it into consideration if they have similar issues, said Cheryl Hannah, a Vermont Law School professor.

It was unclear whether the state would appeal to the high court. The prosecutor on the case was on vacation and unavailable for comment.

Williams challenged evidence the Vermont State Police Drug Task Force obtained against Ellen Sheltra last fall during a raid on her Island Pond home. She was charged with marijuana possession.

The officers were gathering in front of the home Oct. 12 when the door suddenly opened, an officer testified. The agents shouted "state police with a search warrant" and stormed inside, Bent wrote in his ruling.

The judge concluded the officer's testimony wasn't credible, noting that the three adults and two children in the house said they did not open the door.

Police seized 88 grams of marijuana and four guns.

Detroit police executing a search warrant for narcotics and weapons entered petitioner Hudson’s home in violation of the Fourth Amendment ’s “knock-and-announce” rule. The trial court granted Hudson’s motion to suppress the evidence seized. The appellate court rfeversed and allowed the evidence to be used agaisnst Hudson.

Yesterday, the Supreme Court ruled that the evidence obtained can be used.

By all appearances, those in the tax honesty movement have achieved a significant win.

The Dept. of Justice obviously picked on the wrong guy when they indicted Robert Lawrence during March of this year. It would appear they weren't prepared for the legal arguments brought forward by Mr. Lawrence. As a result, they dropped all charges two months later.

What happened in between March and May to change the DOJ's mind regarding Mr. Lawrence? Well, inquiring minds want to know as does Mr. Schulz of the We The People Foundation For Constitutional Education, Inc. He is asking Alberto R. Gonzales, the Attorney General of the U.S. Dept. of Justice, for an explanation of what has just transpired in this highly unusual case. Mr. Schulz's letter along with all of the documents related to Mr. Lawrence can be found at:

What Does this Mean

Lacking any other plausible explanation, this case smacks of legal stonewalling. In other words, by withdrawing the charges, it appears our government is willing to let Mr. Lawrence go free in order to avoid an unfavorable court ruling and precedent that would essentially shut down future IRS collection efforts.

By dismissing this case and the possibility of a negative precedent, the DOJ assures and preserves its ability to continue to abuse other citizens who challenge or otherwise fail to comply with the income tax system. The government also avoids validating the legal arguments advanced by those currently incarcerated. Should we say wrongfully incarcerated?

This dismissal of all charges against Mr. Lawrence combined with the conduct of our government and the courts in the trials we have witnessed here over the passed year further raises suspicions supporting those in the tax honesty movement.

Mr. Lawrence and the citizens of this nation are entitled to an explanation. A prompt response to Mr. Schulz's letter to Mr. Gonzales would be a good start.

Folks,

For the record, by all appearences there are several factions visiting this site. We have government types doing their best to monitor and disrupt us, we have those who wish to advance their notions (some obviously erroneous) as to how and why we shouldn't need to file taxes and we have those who want to instruct us on matters of religion.

Very few seem to comprehend the goals and purpose of the site.

I've been as tolerant as I can be, but it is increasing clear that the goals of this site will never be met if we continue to allow folks to take us off topic with non relevant and often moronic comments.

So, if your sole purpose is to advance your religous beliefs or to bemoan the income tax or to promote awareness for income tax strategies and who is and isn't liable, there are other sites dedicated to that cause.

On the otherhand, if you recognize the failure of our justice system in this country and you care enough to want to expose it for what it is and are interested in working toward ending the abuse of our citizens, then please hang around. We need all of the help we can get.

There is still a lot of work to be done and I appreciate the support to date.

I've been cracking the books hard to teach myself Web site design and HTML programming, and the results are starting to pay off, albeit not monetarily. I've given the top level of my Web site a facelift, and am quite proud of the results. Why not take a look? In other news, attorney Peter Goldberger and I went to the oral arguments session at the appeals court in Philadelphia this past Thursday. A late train and a revised court schedule resulted in me missing the first few minutes, which was the government prosecutor pitching her case. I walked in when Mr. Goldberger was presenting our side. Things move more quickly here than at the "downstairs" court level, so my notes are fragmented. I neither participate nor sit at the "defense" table, but rather sit in the spectator area. It's truly and lawyers forum!

Anyhow, the three judges asked both attorneys a number of questions, and asked them some "what if?" questions to help them determine the impact of our proposed jury instruction on this case, and in light of the previously decided cases here in the third circuit. Leaving out my fragmented notes of the proceeding itself, which went less than one-half hour, here is what Attorney Goldberger told me afterwards about the process. In chronological order, it is as follows:

1. Each judge has already discussed the case with his law clerks.
2. The oral argument day (April 27) is called the submission date.
3. The judges confer at lunch, and perhaps (best outcome for me) add it to the "no-brainer" cases on their list of cases heard that day. These are the cases that can be dispensed with easily.
4. If the case is not dispensed with on the submission date, the presiding judge assigns one of the judges to write a rationale for the decision.
5. The draft write-up is circulated to all of the judges, who discuss it with their clerks again.
6. There might be possible dissention now, based upon the draft.

If the case is of the no-brainer type, we should hear from the court in writing within two weeks; otherwise, there's no time limit rule here so we can end up waiting, in the words of Goldberger, "six weeks to six months."

Breaking the Silence

Dear Subscriber,

Greetings from the federal prison camp in Waymart, PA. Since the verdict in my trial, and throughout my wife's trial, and during my incarceration to date, one of the most frustrating things for me has been remaining silent. Not a day has gone by in which I didn't want to say a thing or two (or ten) to all of you on this list. But being at the mercy of the court, and to a lesser degree our own lawyers, Tessa and I have had to pretty much bite our lips until both of our sentencings had occurred. As of today, we're done being quiet. I am writing this prior to Tessa's sentencing, so I can't comment on how it went. But I have a lot of other things I've been waiting to comment on for a very long time. Now I can, and I will. First, I'm guessing that our prolonged silence was perceived by some as a sign that we had given up, or maybe even decided that we were wrong. Now, at long last, I can rebutt such notions with a resoundinging "Hell, no!" I won't apologize for the ~ silence, as it was necessary to minimize the harm to our family inflicted upon us for crimes we didn't commit. Now that both sentences have been pronounced, we can speak our minds again. And that, as it happens, will be the topic of this, the first in a series of daily messages to be sent to this list.

Chilling Effect 101

My wife and I were wrongly convicted of five misdemeanor counts of willful failure to file federal income tax returns (26 USC 7203). At sentencing, Judge Michael Baylson made it abundantly clear that he would impose a harsher sentence if I did not take down my web sites and stop selling my video. So I did. What, you might ask, do those things have to do with not filing returns (what we were convicted of)? The answer: not a damn thing. This was nothing more than a roundabout way of achieving unconstitutional censorship, and circumventing the First Amendment. That's what the feds wanted, and the court gave it to them. Consider why I've been so silent: because everyone accepted it as self-evident that our "punishment" would be worse if we were to speak our minds prior to sentencing. Take a moment to digest the full significance of that. We had to shut up, because if we said bad things about the government or the courts (regardless of whether the comments had anything to do with what we were convicted of), we would most likely be punished for it at sentencing. First Amendment? What's that? Just how blatant does tyranny have to be before Americans will call it what it is? There is also a chance that when my prison term is up (in November), and I go into "supervised release," that Judge Baylson could make "shut up about 861" be a condition of release. If so, I will fight it. But even the possibility should make freedom-loving people sick.

In addition, my wife and I have already started filing FALSE returns, incorrectly reporting our income as taxable (when we know it isn't) to avoid retaliation from the court. That's a bit ironic: we will be committing FELONIES< by signing returns we know to be inaccurate (see 26 USC 7206) in order to minimize the punishment we receive for misdemeanors we didn't commit. In fact, we've already done so, filing returns for 1997 and subsequent years. We've paid a lot of money, and will pay a lot more, that we know we don't owe to the government, to avoid further terrorist tactics of the IRS, DOJ and the courts. Judge Baylson at sentencing used the word "rehabilitation," which I found sickeningly Orwellian. But if being "rehabilitated" means to stop telling the truth, stop pointing out tyranny and government fraud, and to stop wanting to see truth and justice win... well then I guess I'm not rehabilitated.

I just found out from my attorney Peter Goldberger (who's now handling the appeals phase), that the disposition date for the appeals court is on or about April 28. What this means is that the briefs submitted by the government (boo) and our side (yay!) in March and early April will not even be looked at until that day. At that point, the appeals court either calls for oral arguments or proceeds to set a date -- it could be 'anytime" -- by which it will render a decision. I take all this to mean that we won't be back in Judge Padova's courtroom until it's swimming season.

Thanks to those of you who chipped in a few bucks here and there to help defray legal expenses.

I'm in the process of looking again for full time or contract/consulting work in my field, so if you know of anyone who needs an embedded microprocessor applications engineer, let me know!

Carol Asher is a 66-year old retired nun and school teacher who volunteers tirelessly as an assistant to Retired Phoenix, Arizona Police Officer Jack McLamb. Her energies are siphoned into the organization, Aid & Abet Police & Military organization. As a hard worker and a caring person who strives to help others, she is now facing the possibility of serving 14 years in prison.

Apparently, Asher continued to question the constitutionality of a search during jury deliberations despite the judges assertions that the search was lawful. As we should all know by now, jurors are not permitted to think for themselves in this country.

One must ask where exactly have judges developed this notion that it is the actually meaning then, the Judge’s--prerogative to decide what a law written and defined by the legislature actually means. One would think that a law so complicated and not understandable to an average jurist would be by definition void. Courts have ruled that ignorance of the law is supposedly no defense however, when ones becomes a jurist the court apparently declares them incompetent and tells them what the law is. This appears to be a very self severing double standard.

Word just came in from attorney Peter Goldberger that the Court of Appeals has accepted the government's request to hear the matter. Thus, we're on hold until that court renders a decision. While the news is good for our side, it also means additional time and expense. I'm going to pursue getting back to real work, but the legal fees are high. If you can help defray them, I would appreciate it. Information is on my Web site. I've also put all the newspaper clippings up there as well, on the My Court Case page.

In the "when it rains it pours" department, I went to to Goldberger's office yesterday afternoon to pick up the four, big government exhibit books. I was jogging across Delaware Avenue to make my train, heard the screech of brakes, and out of the corner of my eye caught a glimpse of the car that ran into me (yes, ME). The hood struck me at the top of my "rear bumper," and luckily the car stopped quickly so I was not run over. I have a couple of scraped elbows, a cut on my hand, a stiff neck, and a sore butt. I'm off to the doctor today to get checked out. It's not an experience I want to repeat, especially with my hip situation, but I'm glad the man upstairs was watching out for me.

So far so good with the trial. The government's back is against the wall, as it had to admit that there was never any assessment for the three years mentioned in the indictment. When Judge Padova pointed out that the 3rd circuit (here in Penna.) has ruled that you can't have a tax evasion without an assessment, the government realized its case is in jeopardy and filed an appeal of his ruling to the Court of Appeals. Thus, my district court trial is on hold until word comes down Friday from the 3rd circuit. We'll find out then one of three things: the appeal is rejected as frivolous, the appeal is denied, or the appeal is accepted. If the third, we'll be on hold until that court makes a ruling on the issue. If the first or second, we resume in some capacity on Monday, with the government holding a very poor hand of cards.

Larken Rose Trial Objections

This is all of the objections the government, prosecutor/judicial team raised during Larken Rose's defense. I believe they objected to nearly all of evidence Larken attempted to introduce. Many of these objections appear to be raised by the prosecutor simply because they can raise them and it helps interrupt the defense. The bottom line here is that the pursuit of truth is never a priority in one of these trials. In fact, in this case, the prosecutor and judge seem preoccupied with shielding the jury from the truth in most instances.

After listening to this string of objections, it seems like Larken's defense was ineffectual. That is the effect and motivation behind the government's persistent objections many of which are trivial, or should I say frivolous. They disrupt the defense and make them appear inept before the jury.

Anyone who has expended even a little bit of time reviewing Larken's research, would quickly conclude, right or wrong, that he was sincere in his beliefs, and therefore, could not be guilty of willful failure to file. The government knew that and they knew the only way they could defeat Larken was by preventing Larken from exposing the jury to his well researched and documented beliefs. The government needed to prevent the jury from seeing Larken's report and video's which would have presented his position very clearly in a manner the jury could have understood. They also needed to assure they interfered with any attempt by Larken to present his research findings. They needed to assure Larken never found the traction he needed to present his findings in a manner the jury could comprehend.

And, so it is that the sole purpose for many of the government’s objections was to disrupt Larken's defense. The disruptive nature and intent of these objections is evidenced by the number of objections that were overruled by a prosecutorial friendly judge, a judge who raised more than one objection on behalf of the prosecution while never raising one for the defense. The transcript reveals this judge was working as part of the prosecutorial team with the judge himself raising objections on behalf of the prosecution. At the same time, he elected not to raise one objection on behalf of the defense.

We should also mention that Peter McCandless was going to testify about the responses they received from queries to H&R Block regarding section 861. The judge deemed that irrelevant. Yet, the prosecutor stated in his closing arguments to the jury that Larken’s questions regarding section 861 could have been answered if he had simply walked into any H&R Block. They included that assertion in their closing argument knowing full well that they had just succeeded in preventing Peter McCandless from testifying that he and Larken had done exactly that. Now, how despicable is that.

In the end, it is clear that the prosecutors with the help of the judge were successful at denying an inexperienced pro se litigant from presenting his case to the jury, and our government celebrates the wrongful conviction of yet another innocent man. This scenario plays out every day in our justice system, and it will continue to play out repeatedly as long as the citizens of this nation are content to sit back and watch without taking action.

Our judicial system has numerous victims, particularly among this nation's poor, who are never truly afforded the opportunity to present their case. Maybe it’s time we at least acknowledge what is happening in these courts. I’m sure the list of victims is enormous. The wrongful denial of freedom and the imprisonment of an innocent man for even one day is unacceptable.

When you mail people in Club Fed remember the following:

(1) Include no paper clips or staples. Seriously....Club Fed's Cruise Directors consider them contraband as they most likely get used as weapons when people want to cut short their stay.
(2) Do NOT include SASE or stamps or the like. Even Post Office pre-stamped envelopes are taboo.
(3) ALways put a reutrn address on the letter. ANy w/o a return address risk being retained till the person is out.
(4) If you want to send a book, it has to come from the publisher.

Send Atlas Shrugged if you can. Club Fed's Cruise Directors really like their vacationers educating the dumb masses in prison.

I'm compelled to offer a commentary of my own after reading many of the comments on this blog.

It has been particularly difficult the past few months watching some of our finest citizens face defeat in our court system while fighting the good fight, and I know many of you, like me, are disheartened by these losses.

The problems are surely rooted at all levels. They include a federal legislature that usurps our rights and trashes our constitution, unethical prosecutors and judges, mentally challenged jurors that have never been exposed to the concepts of freedom or the inside of a law library, and defendants with flawed arguments and poor representation. The list goes on.

If we are ever going to succeed at turning this country around and restoring respect for individual rights and liberties, then we need to understand the dynamics of what confronts us.

Questions arise from the given definitions of employer, employee, gross income, taxable income, etc, the proper application of that pesky section 861, the cross reference table that somehow points in all the wrong directions, the absence of proper procedure in applying for OMB designations, the abuse of powers claimed by authorities under 6020b, abuses of power exceeding authorities granted via pocket commissions and the abuses of levies and liens. The list goes on.

Our courts claim the income tax code too confusing and problematic for a jury, yet they eagerly cooperate with the prosecution in persecuting our citizens who question the interpretation of this same law they seemingly admit is too confusing and problematic for a citizen jury. Shouldn't the courts grant the benefits of the Void for Vagueness Doctrine to any defendant charged with an inability to comprehend the 40,000 plus page tax code written in legalize?

There is a dynamic here that we really need to understand. We have just witnessed juries return guilty verdicts in the prosecutions of Larken Rose, Irwin Schiff, Tessa Rose, and Ward Dean. Somehow these juries never grasped the seriousness of the issues and the questions involved. Instead they seem mesmerized by the prosecuters potrayal of these defendants as deadbeats who don't want to pay their fair share.

We need to do several things right now.

1. Conduct a thorough review of the transcripts from each of these trials highlighting judicial and prosecutorial misconduct and identifying the elements of the governments cases.

2. Conduct recorded interviews with all willing jurors in an effort to understand their reactions to what unfolded in these courts.

In my opinion, task one needs to be completed first in order to conduct a thorough and effective interview with jurors. Once that is completed we can begin the process of arranging interviews with willing jurors.

Please note that it is imperative that jurors are not harassed in any way. Any sense of intimidation will influence their comments and negate any of the resulting findings. Whether or not they wish to particpate is their perogative. I suspect most will not want anything to do with interviews, and that greater success may be realized if we work within the law with reputable third parties to make these arrangments with jurors. I'm sure the government has done similar research in the past.

I also know, in the past, there have been comments left at this and other web sites by angry folks wanting to contact jurors. I would urge anyone who has considered contacting these jurors not to. Peaceful solutions must be found to whatever problems confront us and this nation.

The conduct of the courts in the past several trials should provide sufficient evidence of the unjust and oppressive nature of the system. If so, we should be able to make that apparent through this and a companion web site in the near future. We are still waiting for the transcipts to me made available in these trials. Once we have those we can begin to identify any misconduct.

This battle is not only being lost in the courts, it is being lost in the pool of public opinion. We need to put aside our differences, unite and work together through peaceful means in order to restore this nation to its original greatness.

Let's start by putting together a simple list of the legal question and challenges raised by each of these defendants in a manner that is simple for the general public to comprehend without expending hours of research. Then, let's put together a list of actions the government has taken during these trials to prevent the juries from ever being exposed to the defendants positions.

It seems to be a simple post mortum and it will take time, but we need to get it done.

Arthur Farnsworth trial has been rescheduled once again as per the following announcment released today.

As the subject line says, my trial has been delayed once again. The judge had us at a hearing yesterday (Monday), at which we asked for a short delay for two reasons - my attorney incurred late last week which has rendered him immobile, and we've not yet had time to go through the voluminous Brady evidence we obtained copies of on December 2. We didn't even get all of the items we requested, although that issue wasn't raised at the hearing. Since the trial should take one week, I believed we were going to start on December 19, or perhaps the middle of the week before, but it's a four day week that starts December 19, as everybody leaves early for Christmas on Friday the 23rd. A new date has not yet been established, but it'll most likely be January or February.
